GENERAL TERMS AND CONDITIONS

GENERAL

  1. SCOPE OF APPLICATION

These General Terms and Conditions (hereinafter referred to as GTC) apply to the provision of rooms and restaurant premises as well as to all other associated services and deliveries by Hotel Gletschergarten AG to customers. All offers of the Hotel Schweizerhof are based on the following GTC. They form an integral part of every contract. Should the present GTC contradict any contractual conditions of a customer, the present GTC shall take precedence.

  1. CONCLUSION OF CONTRACT

Following the reservation by the customer, the customer receives a written reservation confirmation from Hotel Gletschergarten AG. The contract between the parties is only concluded with this written reservation confirmation from Hotel Gletschergarten AG to the customer.

  1. SERVICES, PAYMENTS AND PRICES

Hotel Gletschergarten AG undertakes to provide the services ordered by the customer and confirmed in writing by Hotel Gletschergarten or Hotel Fiescherblick. All prices are in Swiss francs (CHF) and include the statutory value added tax (VAT). Hotel Gletschergarten AG is entitled to demand an appropriate deposit at any time. The amount of the deposit and the payment dates shall be agreed in writing in the contract. If the customer does not fulfil his obligation to pay the deposit in due time, Hotel Gletschergarten AG is entitled to withdraw from the contract after setting a reasonable period of grace. The customer is liable to Hotel Gletschergarten AG for any resulting damage. If no advance payment is made by Hotel Gletschergarten AG, the entire invoice amount must be paid by the customer by credit card (Master, VISA, American Express, Diners, JCB), debit card (EC/Maestro, Postcard, TWINT) or in cash by the time of departure at the latest. If payment by invoice is agreed, the entire invoice amount is due 10 days after the invoice date. In the event of late payment, Hotel Gletschergarten AG is entitled to charge interest on arrears at a rate of 5%. Hotel Gletschergarten AG expressly reserves the right to change prices.  Hotel Gletschergarten AG does not send invoices abroad. The contracting party agrees to make an advance payment of 100% of the total amount of the services agreed in the contract up to 10 days before arrival, provided the invoice address is not in Switzerland. The remaining amount (services after consumption) is to be paid on the day of the event.

  1. LIABILITY

The customer is liable to Hotel Gletschergarten AG for all damage and loss or other damage caused by himself, his employees, his agents or event participants or other third parties. Hotel Gletschergarten AG declines all liability for theft and damage to items brought in by the customer from event participants or third parties. The insurance of exhibits and other items brought in by the customer, event participants or third parties is the responsibility of the customer. Hotel Gletschergarten AG may demand proof of sufficient insurance from the customer at any time. The customer is obliged to maintain peace and order. The customer undertakes to indemnify Hotel Gletschergarten AG in full against all civil and public law claims brought against Hotel Gletschergarten AG by authorities or third parties (including event participants, guests or employees and contractual partners of the customer) on the basis of the customer’s event, or to pay for all corresponding claims. Hotel Gletschergarten AG is only liable for intentional or grossly negligent contractual or non-contractual damage and only for direct damage. Any further liability, in particular for slight or medium negligence or for indirect damage, such as in particular loss of profit, is excluded.

  1. CANCELLATION BY HOTEL GLETSCHERGARTEN AG

If the service to be provided by Hotel Gletschergarten AG under the contract is made considerably more difficult or impossible in whole or in part by force majeure or other circumstances for which Hotel Gletschergarten AG is not responsible, Hotel Gletschergarten AG may withdraw in whole or in part without compensation to the extent of the part of the contract not yet fulfilled. Hotel Gletschergarten AG is also entitled to withdraw without compensation if there is reasonable cause to believe that the events may jeopardise the smooth running of the business, the safety or the reputation of Hotel Gletschergarten AG in the eyes of the public or if the customer breaches clause 12 of these GTC. Any claims for damages by Hotel Gletschergarten AG against the customer are expressly reserved.

HOTEL ROOMS

  1. ARRIVAL AND DEPARTURE TIMES

The hotel rooms are ready for occupation from 15.00 hrs on the day of arrival and must be vacated before 12.00 hrs on the day of departure.

  1. BLOCK BOOKINGS/ROOM ALLOTMENTS

Hotel Gletschergarten AG will receive a list of participants from the customer at the latest 14 days prior to arrival with the following details: First and last names of all guests, time of arrival, payment conditions of the guests. After the deadline set by Hotel Gletschergarten AG, the rooms still available in the respective contingent will be released for open sale.

  1. CANCELLATION CONDITIONS

The following cancellation conditions apply both to the cancellation of bookings and to no-shows as well as in the event of early departure. The cancellation conditions at Hotel Gletschergarten AG are as follows:

Cancellation up to 14 days before arrival: free of charge

Cancellation up to 7 days before arrival: 50% of the booked stay

Cancellation up to 3 days before arrival: 100% of the booked stay

The cancellation conditions may be modified by Hotel Gletschergarten AG at times such as Christmas & New Year and during other dates. If the cancellation conditions are not stated in the reservation confirmation, the above guidelines apply.

The hotel reserves the right to stipulate individual cancellation conditions in the contract.

  1. FIRE REGULATIONS/OTHER SAFETY REGULATIONS/INSTALLATION OF DECORATIVE MATERIAL

The organiser undertakes to comply with the fire regulations of Hotel Gletschergarten AG, in particular the keeping of escape routes clear, the observance of the smoking ban etc.. Decorative material brought in by the organiser must also comply with the fire regulations. The organiser is also responsible for ensuring that no more persons are admitted than the capacity of the room in question. The maximum numbers specified by Hotel Gletschergarten AG are binding. In the event of any infringement, Hotel Gletschergarten AG declines all liability. The attachment of decorative materials and other objects to walls, doors and ceilings always requires the prior consent of Hotel Gletschergarten AG. The organiser is liable for any damage incurred by Hotel Gletschergarten AG as a result.

  1. PRINTED MATTER/MEDIA ADVERTISEMENTS

The use of Hotel Gletschergarten AG logos/images in any form by the organiser always requires the prior written consent of Hotel Gletschergarten AG. If publication takes place without the corresponding consent, Hotel Gletschergarten AG is entitled to withdraw from the contract. The organiser is liable to Hotel Gletschergarten AG for any resulting damage.

APPLICABLE LAW/PLACE OF JURISDICTION

The contract shall be governed exclusively by Swiss law. The place of jurisdiction shall be the Bern Cantonal Court in the Canton of Bern. Should individual provisions of these GTC be invalid, this shall not affect the validity of the remaining provisions. In such a case, the legally ineffective provision shall be replaced by a provision that is similar in spirit but effective.
